TERMS AND CONDITIONS OF SALE

1. Anvil Publishing Limited will not be liable for any omissions or mistakes caused by faulty copy received by any method including, but not limited to, mail, courier or electronic.

 

2. Anvil Publishing Limited will not be liable for any copy not received by due date.

 

3. Anvil Publishing Limited will not be liable for any misuse of third party intellectual designs, logos, or statements misrepresented by the client.

 

4. Anvil Publishing Limited advises that it makes no guarantee of any date of publication but will use its best endeavours to meet any advertised date.

 

5. The client warrants that nothing in the advertisement(s) lodged by them for publication constitutes a breach of trademark, patent or copyright or constitutes a defamation or contains any illegality whatsoever for which Anvil Publishing Limited may be liable.

 

6. The client indemnifies Anvil Publishing Limited against any liability for any expense howsoever incurred as a consequence of there being a breach of trade mark, patent or copyright or contains defamatory or illegal statements inadvertently or otherwise and notwithstanding the warranty given in clause 5 above.

 

7. Upon Anvil Publishing Limited agreeing to open a credit account for the client the client agrees that:

a: Payment will be made in full without deductions on the 20th of the month following the invoice date.
b: The client will pay interest of 2% a month on any overdue portion of the account.
c: Anvil Publishing Limited may stop any credit facilities without notice.
d: The client will pay all costs associated with the collection of overdue amounts.

 

8. The client authorises Anvil Publishing Limited to request such information as it may require in regard to making credit facilities available to the client.

 

9. The client authorises Anvil Publishing Limited to supply any third party any details contained in the application for credit and details of any subsequent transactions between the parties.

 

10. Individual advertising contracts will only be entered into at the discretion of Anvil Publishing Limited’s Managing Director.

 

11. In the event of the client and Anvil Publishing Limited entering a contract for advertising the client agrees that:

a: The size of the advertisement subject to the contract may not be reduced and/or in the case of multi colour advertisements have less colours than contracted.
b: If the client cancels the contract prior to its expiry date then the client agrees to pay the difference between the contract price and the standard price of one off advertising for the amount of space contracted for.
c: Cancellation of the contract by the client will occur after one months notice in writing has been received by Anvil Publishing Limited.
d: The client agrees to pay for any space booked but not used during the contract period including the one month notification period.
e: Anvil Publishing Limited may cancel the contract without notice for any reason.

 

12. Failure to provide advertising copy by 5pm on the 20th day of month of publication may result in a repeat of most recent advertisement or invoice of space booked.

 

13. All advertisements designed by Anvil Publishing Ltd remain the property of Anvil Publishing Ltd.

 

14. Placement of advertising constitutes an acceptance of the above terms and conditions.
